North Texan Kevin Wayne Powell Gets Life Without Parole For Murdering Former Live-In Girlfriend

FORT WORTH (CBSDFW.COM) – A Tarrant County jury took a little more than an hour to find Kevin Wayne Powell, 50, guilty of the capital murder of his former live-in girlfriend, Kasey Rae Nutter.

Powell, of White Settlement, received an automatic sentence of life without the possibility of parole for his crime.

The Tarrant County Criminal District Attorney’s Office explained, in the fall of 2015, Nutter made multiple claims of abuse against Powell, including a pending charge of aggravated assault with a deadly weapon.

According to witnesses, Powell became paranoid that Nutter was talking to police behind his back, and she feared he may seek retribution against her.

Nutter’s last known communication to anyone was December 12, 2015.

After she was reported missing by her grandmother in early 2016, an investigation was launched to locate Nutter. A relative of Powell’s ultimately came forward, painting a gruesome picture of Kasey’s last moments, according to the Tarrant County DA’s office.

The relative testified Powell had told him that he had “taken care of” Kasey by murdering her, cutting her body into small pieces with multiple power saws, then dissolving the remains in chemicals and disposing of them.

Evidence was found that Powell, a contractor, had repainted the bedroom of his home and began covering portions of the room with furniture screwed into the wall. He also pawned his saws shortly after the missing person’s report was filed.

Police obtained a search warrant for Powell’s home and found DNA evidence confirmed to be Nutter’s along floors and baseboards near the portion of the room he tried to hide. The search for Nutter lasted three years while the case was pending, but authorities never found any information she was alive.

“Kasey was living a life of terror at the hands of the Defendant and saw no way out,” said prosecutor and Intimate Partner Violence team Chief Allenna Bangs.

Powell’s defense attempted to downplay his violent history of abuse, and make the case that Nutter’s past as an exotic dancer and drug user with a history of mental illness had brought her into contact with other people who could have killed or exploited her.

“His abuse and her untimely death should not have been the end of her story. She deserved better, and the jury saw fit to rectify that,” said Bangs.

“We’d like to thank all the medical personnel and domestic violence prevention volunteers who treated Kasey and tried to help her,” said prosecutor Page Simpson. “Their contribution to this case was invaluable.”


Brenda Delgado Found Guilty Of Capital Murder In Death Of Dallas Dentist Kendra Hatcher

DALLAS (CBSDFW.COM) – A jury has found Brenda Delgado guilty of capital murder in the death of her ex-boyfriend’s love interest Kendra Hatcher.

Prosecutors said Delgado hired two people to kill the Dallas dentist in 2015 and rob her to make it look like a random violent crime as a cover.

The prosecution rested its case Thursday morning, and the jury heard closing arguments Friday morning.

The jury quickly deliberated and released their verdict soon after.

The case moved immediately to victim impact statements where Hatcher’s mother, Bonnie Jameson and sister gave emotional statements, condemning Delgado for her crime.

“You Brenda Delgado have earned your spot, here on this earth behind cold, steel bars for the rest of your miserable, pathetic life,” said Jameson. “And if justice could have handed you a death sentence, make no mistake, I would have been there front and center.”

Hatcher’s sister echoed her mother’s sentiment, telling Delgado pointedly, “I hope you rot in hell.”

Through her tears, Hatcher’s sister expressed how much the murder impacted so many others. She continued,”Brenda you’re disgusting. Who the hell do you think you are? You will go down in history as one of the most hated woman in Dallas, maybe even in America.”

The jury heard from Crystal Cortes, who was convicted in the killing Hatcher in the parking garage of her Uptown apartment, as she talked about plotting the murder with Delgado. “She wanted to get rid of Kendra Hatcher because she was envious of her,” she said.

Kristopher Love was also convicted for his involvement in the killing.

Prosecutors also showed the jury binoculars that Cortes said she and Delgado used to spy on Hatcher from her dental office. Prosecutors said Delgado was driven by jealousy.

During the trial, the jury also shown video of Delgado’s interrogation where she convinced detectives she had an alibi the night of the murder.

Delgado was arrested months later in Mexico after police reached the conclusion that she hired two people to commit the murder.

3 Teens Charged With Capital Murder In Shooting Of 29-Year-Old In Dallas

DALLAS (CBSDFW.COM) – Three teenagers have been charged with capital murder in the shooting death of a 29-year-old man in Dallas last month, according to police.

Police said Nicholas Edwards was found with multiple gunshot wounds on May 27 in the 3100 block of Mahanna Street. He was later pronounced dead at the hospital.

On Friday, police said they arrested Jamie Israel Saenz, 17, and Lupe Anthony Zavala, 18, and took them to the Dallas County Jail, where they were charged with capital murder. A mugshot for Saenz has not yet been made available.

A third suspect, 19-year-old Carlos Rodriguez-Quinones, was already in the Dallas County Jail on unrelated charges. A capital murder charge was added against him.

Luis Alejandro Espinoza Wanted In Garland Convenience Store Murder; Considered Armed And Dangerous

GARLAND, Texas (CBSDFW.COM) – Garland Police said Tuesday night they’ve identified one of two suspects wanted for capital murder of a convenience store clerk on Saturday, May 22.

Luis Alejandro Espinoza, 18, is one of the two men police said robbed a convenience store in the 4400 block of West Walnut around 11:30 p.m. that night.

When officers arrived, they found Heng Lam, 30, shot.  He later died of his injuries at the hospital.

Investigators were able to obtain security video showing two men entering the store with handguns drawn, demanding money from two clerks.

Espinoza is considered armed and dangerous.

Police Arrest Garland Convenience Store Murder Suspect Luis Espinoza

GARLAND (CBSDFW.COM)Police believe he shot a 30-year-old Garland convenience store clerk to death last month and he was considered armed and dangerous. Today Luis Espinoza is in police custody.

Espinoza was found on the morning of June 12 at a house in Dallas. The 18-year-old is one of the two men who police say robbed a convenience store in the 4400 block of West Walnut and shot and killed worker Heng Lam.

Security video from the store shows two men entering with guns drawn. The pair demanded money from two clerks working just before midnight. Lam was shot during the robbery.

The investigation led detectives to identify one of the suspects as 18 year old Luis Alejandro Espinoza.  An arrest warrant for capital murder has been issued for his arrest.

Officials say their investigation into the murder is ongoing and detectives area still working to identify and arrest the second suspect.

Drug Suspect Now Faces Capital Murder Charge In Death Of Midlothian Man Found In Pickup

MIDLOTHIAN, Texas (CBSDFW.COM) – Midlothian Police have found, and are preparing to charge, the man wanted in the murder of James Morris, 52, of Alvarado.

Morris was found dead inside his pickup truck on Monday in the 1100 block of Auger Road.

Police said shortly after they secured an arrest warrant for Woodrow Stevenson Head, 33, on Tuesday, investigators found out Head was in the Cooke County Jail on an unrelated drug charge.

Midlothian Police said investigators have been working throughout the night with officials in Cooke County and Head will be charged with capital murder in Morris’ death.

Police have not released any details on a motive and said this is an ongoing investigation.

Dallas Police Investigating 4 More Homicides Since Thursday Morning

DALLAS (CBSDFW.COM) – Four more homicide cases have reached the desks of detectives in Dallas since Thursday morning as a violent year for the city continues.

Starting Thursday morning, police said they responded to a welfare call at around 10 a.m. in the 2100 block of Lucas Drive in regards to an unusual smell coming from a residence.

According to police, Dallas Fire-Rescue responded, as well, and forced their way into the home. They found 47-year-old Andy Longoria dead inside the home.

Police are investigating the case as a capital murder and do not have any suspects.

Later that day, police said officers responded to a shooting call at the Rosemont Apartments in the 9900 block of Scyene Road at around 7:15 p.m. An unidentified victim was found in the parking lot with multiple gunshot wounds.

The victim was taken to the hospital where he was pronounced dead. There have been no arrests made in this case.

The latest case involves a man and a woman who were found shot to death inside an apartment near East Grand Avenue and Casa Loma Avenue and close to the Lakewood area of Dallas early Friday morning.

“I heard a, somebody kicking in the door like three times. And then as soon as the door opened I heard like five gunshots. Pop, pop, pop, pop, pop. Five or six gunshots,” said Carlos Aguilar who lives at the apartment.

The woman had only lived at the apartment for a month. A witness told CBS 11 News she had at least a couple children.

According to police, this case is being investigated as a capital murder. No further information was released as the investigation continues.

Dallas police told CBS 11 News that there are now 103 homicides that have occurred in the 2019.

Dallas Police Arrest Suspect In Double Murder At Lakewood Area Apartment

DALLAS (CBSDFW.COM) – Dallas Police arrested Leo Ted Pintor, 40, and charged him with capital murder in the shooting deaths of Urania de Jesus, 34, and Fredi Mercado, 31, early Friday morning.

It happened at the Coronado Apartments at 7414 E. Grand Avenue shortly after 3:00 a.m.

Witness told CBS 11 Friday morning, they heard two loud knocks and then four or five gunshots around the time the incident occurred.

“It’s unsettling. It puts us on edge. We’re more cautious. That depends on what the circumstance was. Not having the information is unsettling as well. Knowing that it was a violent act. Anyone would feel fearful,” witness Kendrea Rubin said.

Police have not said how or if the suspect knew the victims.


Affidavit: Murder Suspect, Victim Were Going Through Divorce Before Shooting At Dallas Apartment Complex

DALLAS (CBSDFW.COM) — The man police arrested for a double murder at a Dallas apartment complex June 21 has been identified as the estranged husband of one of the victims.

Leo Ted Pintor, 40, was charged with capital murder for the deaths of Urania De Jesus, 34, and Fredi Mercado, 31.

Police received a call around 3 a.m. Friday regarding multiple gunshots coming from the Coronado Apartments on East Grand Avenue. A witness observed a Hispanic male — later found to be Pintor — wearing a gray shirt kicking on the door shortly before hearing several gunshots.

According to Pintor’s affidavit, through their investigation, detectives determined Pintor and De Jesus were going through a divorce at the time of the murders.

Pintor had a reported history of family violence with De Jesus, and she even had an active protection order against him.

Detective Andrea Isom interviewed Pintor’s family members, who informed them of a phone call Pintor made to them around 6 a.m. stating that he “messed up” and wanted them to take care of his children, the affidavit said.

The Dallas Police Fugitive Unit officers began looking for Pintor, who had outstanding traffic warrants and later found him at a Dallas residence wearing the same clothes the witness described.

Suspect Pintor was transported to Dallas Police Headquarters where he did not provide a statement.

No bond has been set.

Texas Rapper Made Video While On The Run, Today Taymor McIntyre Is In Court For His Murder Trial

NORTH TEXAS (CBSDFW.COM) – A murder trial is underway for a North Texas rapper who when he was just 16-years-old recorded a song while on the run for murder.

Taymor McIntyre, aka Tay-K, is accused of playing a part in the 2016 shooting death of Ethan Walker during a home invasion in Mansfield.
This morning, Walker’s girlfriend testified the victim was shot in the stomach while he had his hands in the air.
McIntyre has already pled guilty to being part of the robbery, but entered a plea of not guilty to the capital murder charge.
The now 19-year-old from Arlington has also been implicated in the robbery and murder of a man in San Antonio, and the aggravated robbery of a 65-year-old man in Arlington.
While on the run in 2017, after cutting off his ankle bracelet and fleeing house arrest, McIntyre released a song called “The Race”. The YouTube video of the song, that has nearly 175 million views, shows Tay-K waving a gun and posing next to a wanted poster of himself.
Since being captured and returned to Texas from New Jersey, McIntyre has also been accused of trying to start a jail gang while behind bars.
The trial is expected to last about a week.

Murder Trial Witnesses: Texas Rapper Tay-K Was Part Of Plan To Use Sex And Guns During Robbery

FORT WORTH (CBSDFW.COM) – Teenage rapper Tay-K is back in court in Fort Worth today for a second day of testimony in his capital murder trial.

From the witness stand Tuesday — eye-opening testimony about teens using sex and guns as part of a robbery plan meant to get drugs and money. That testimony came from one of the teenaged girls who planned the 2016 home invasion robbery that left 21-year-old Ethan Walker dead.

The girl testified she reached out to Taymor McIntyre, aka Tay-K, on Instagram believing he would be able to secure guns for the plan.

Walker, a young father, didn’t have any of the drugs or money the teen robbers were after.

Testimony Wednesday focused on Walker, namely explaining how a single shot to the stomach killed him.

McIntyre gained notoriety after the crime. He cut off a GPS ankle monitor, went on the run, and recorded songs and videos about the whole thing while evading authorities.

A video McIntyre posted online, showing him waving a gun and posing next to a wanted poster of himself, has nearly 175 million views.

The now 19-year-old was eventually located and taken into custody in New Jersey. Today an investigator from that state took the stand and told jurors how after they found McIntyre the teen tried to avoid going to jail by first claiming he’d swallowed a bottle of pills; and then claiming he was hearing voices.

Before the lunch hour a police investigator was on the stand.

A man who was also shot during the home invasion in Mansfield is expected to testify later today.

Mabank Mother Sarah Henderson Pleads Guilty To Killing 2 Young Daughters, Gets Life Without Parole

ATHENS, Texas (CBSDFW.COM) – A Mabank mother pleaded guilty to two counts of capital murder Wednesday and was sentenced to life in prison without parole.

She also attempted to shoot her husband Jacob as he lay sleeping, however the .380 caliber pistol failed to fire, waking her husband who took the gun away from her and called 911, according to the Henderson County District Attorney’s Office.

Earlier in the evening, an ambulance had been called to the residence because Henderson was exhibiting odd behaviors that alarmed her husband. Prior to the arrival of EMS however, Jacob called back to say that things had settled down and there was no need for service.

Henderson County Sheriff’s deputies continued to the residence to perform a security check, but were told by both Hendersons that everything was alright.

Several hours later, the frantic call from Mr. Henderson came in saying that both girls were dead. Henderson could be heard in the background asking what she had done and saying that she was going to hell.

Family, Friends Remember ‘Adorable’ Girls Allegedly Shot To Death By Their Mother

After her arrest, she confessed to shooting her daughters and attempting to kill her husband.

When asked why she did it, she said, “I was going crazy” and “Just caught up in everyday life, you know”. She further indicated that she thought people were out to get her which was confirmed by Jacob and a friend she had been with the preceding day, each of whom described her paranoid behavior leading up to the shooting.

In accordance with the Court’s deadline for the State’s election on punishment, District Attorney Mark Hall filed notice that the State would seek the death penalty on June 1, 2018, while reserving “the right to withdraw this election and seek a sentence of life without parole should the defendant’s mental condition be deemed to preclude death, or other circumstances that may arise.”

Some months after her arrest, Henderson was examined by two psychologists who both determined that she was mentally competent to proceed to trial. The defendant then filed notice in August of 2018 that she would seek to claim insanity as a defense. In February 2019, the parties and the Court received the reports from two Court appointed psychologists regarding the defendant’s sanity at the time of the offense. One of which found her sane, and one insane.

A person is insane if “ … at the time of the conduct charged, the actor, as a result of severe mental disease or defect, did not know his conduct was wrong.” The question of sanity is left for the jury to decide, and if it finds the person insane, a verdict of not guilty by reason of insanity is entered and the Court proceeds to a determination of civil commitment to a mental institution or outpatient treatment for evaluation and treatment.

The Court must then hold a hearing not later than 30 days to determine if, as a result of severe mental illness, the person is likely to cause serious harm to another. If so, the person may be committed to either inpatient or outpatient care until discharged by the court. The period of commitment cannot exceed the maximum term provided by law for the underlying offense, which in the case of capital murder is life.

“Even with the split decision on Henderson’s sanity, I believe the facts and her own statements show that she knew her actions were wrong but with this plea, which was requested and approved by both Jacob Henderson and the father of one of the girls, we know that Sarah Henderson will be locked away for the rest of her natural life. The bars that keep her confined will be a daily reminder of what she did to two beautiful little girls; girls who loved her as their mommy, and trusted that she would protect them.”, said Hall.

“Choosing between death or life without parole is a difficult decision, but given all the facts and circumstances, I am confident that this plea will allow the family to move forward without being concerned whether Henderson will be eventually released from a mental hospital. She has also waived appeal of her conviction and punishment which brings some finality to a case where even if she had received the death penalty, it could take decades and endless court hearings, legal briefs and additional expert evaluations before actually carrying out the sentence.”

Man Arrested In Fort Worth For Allegedly Killing Girlfriend’s 2-Year-Old Son

FORT WORTH (CBSDFW.COM) – Fort Worth Police have arrested a man for the death of a 2-year-old boy.

Police said Terrance Farris, Jr., was watching over his girlfriend’s children on April 27 when the child “went unconscious.”

It happened at the Carlyle Crossing apartment complex in the 6300 block of Vega Drive.

Paramedics rushed him to the hospital with multiple injuries, including broken ribs and internal organ damage.

He did not survive.

Police said Farris told them the toddler soiled himself and he admitted he hit the child as punishment.

The Tarrant County Medical Examiner’s report was issued July 8.

It showed the child suffered multiple traumatic injuries, including contusions and ab: large spleen laceration, internal hemorrhaging and other significant internal injuries and concluded the child died from homicide.

Deadly Home Invasion Survivor Testifies At Taymor McIntyre’s Capital Murder Trial

FORT WORTH (CBSDFW.COM) – A teenager who survived a deadly home invasion involving rapper Tay-K, said he faced down a masked and hesitant gunman that night for as long as two minutes.

It was only when the shooter grabbed the gun with two hands, Zachary Beloate testified, that he knew he was about to pull the trigger.

The testimony came during the third day of a capital murder trial against Taymor “Tay K” McIntyre.

Beloate, who was 17 at the time, said he never heard the shot that was fired that killed his roommate that night, 21-year-old Ethan Walker. After the seven assailants left the house, Beloate said left his room to find Walker laying in the hallway.

“And I seen Ethan gasping for air, and I said, ‘You going to be ok?’,” he testified. “Then I went to grab a gun and go out the front door.”

He later found out Walker was dying, when he could hear medical staff in the hospital emergency department saying they were going to lose him.

McIntyre is one of seven defendants accused in the 2016 crime. The others have all reached deals with prosecutors or been found guilty.

Jurors watched a nearly three-hour video Wednesday of the day Mansfield police investigators interrogated McIntyre, who was 16 at the time.

After initially denying knowing anything about the crime, he slowly began to admit to some elements, including that his job that night was to find drugs in the house to steal.

His defense team has keyed on that for the first few days of the trial, pointing out that others were responsible for planning the crime, and firing the fatal shots.

Though he was initially held in juvenile detention following that interview, he was released months later, and cut off a GPS ankle monitor and went on the run.

Eventually a fugitive task force tracked him to New Jersey. An officer testified that after arresting McIntyre, he claimed to have swallowed a bottle of pills, and then later that he was hearing voices, in order to try to stay out of jail.

McIntyre is facing life in prison if he is convicted.

FORT WORTH (CBSDFW.COM) — The state and defense have rested its case in the capital murder trial of teen rapper Tay-K — also known as Taymor McIntyre — and the jury could be deliberating by Thursday afternoon.

Attorneys are currently in the courtroom going over potential charges against McIntyre other than capital murder.

After initially denying knowing anything about the crime, the teen rapper slowly began to admit some elements, including that his job that night was to find drugs in the house.

All along, the defense strategy has been to get the jury to decide McIntyre played a role in a deadly home invasion, but was a minor player compared to the others involved.

Prosecutors finished making their case Thursday morning on an emotional note. After two days of testimony about teens plotting a robbery, and finding guns to go after drugs and money, mother of Ethan Walker — the 21-year-old who was killed in the 2016 robbery — took the witness stand.

She said he had recently moved into the Mansfield house where it happened and had no drugs and money, and that’s why he was killed with a single shot to the stomach.

Before that, a girl who was there that night, testified that McIntyre was joking after the crime, and that they had killed him for a small amount of money and a watch. Two days later, she said he and friends were hurriedly packing clothes, calling a “code red,” and preparing to get out of town.

Six other defendants have already reached deals, or been convicted in the case.

Jury Finds North Texas Teen Rapper ‘Tay-K’ Guilty Of Murder

FORT WORTH (CBSDFW.COM) — A North Texas jury found teen rapper Taymor “Tay-K” McIntyre guilty of murder Friday morning.

The 19-year-old hung his head slightly as the judge read the verdict.

Earlier, the jury has asked to see evidence presented when the medical examiner testified about the victim, Ethan Walker. The group took another look at autopsy photos, as well as the single bullet that killed the 21-year-old.

Walker was shot in the stomach after he told McIntyre and a group of other robbers that he didn’t have any drugs or money.

McIntyre wasn’t the person who fired the gun that killed Walker, and his attorneys argued that was one of the reasons he should be found not guilty.

Prosecutors made their case arguing that McIntyre knew the plan to steal drugs and money from the house in Mansfield in 2016, would end with someone being shot.

A 15-year-old girl actually planned the home invasion robbery. Earlier this week one of her friends testified that she reached out to McIntyre on Instagram, believing he could get guns for the robbery.

McIntyre responded to her saying he didn’t have a gun, but his friends did and he knew one who was “trigger happy.”

He gained notoriety after he went on the run, and recorded songs and videos referencing the crime.

The jury now has to decide how long McIntyre will be in prison. They started hearing about the victims of other crimes McIntyre has been connected to after the murder.

Though McIntyre avoided the life sentence that would have come with a capital murder conviction, he could still serve up to 99 years.

District attorneys said they should finish his sentencing sometime Monday morning.

Boy Charged In Rape, Murder Of Dallas Woman Maria Ezquerro Will Be Tried As Adult

DALLAS (CBSDFW.COM) – A 16-year-old boy will be tried as an adult after being accused of raping and killing a Dallas woman when he was 15 years old, the Dallas County District Attorney’s Office confirmed.

Lenario Washington was charged in the capital murder of 23-year-old Maria Ezquerro after she was found dead in her apartment on Peterson Lane on Nov. 27, 2018.

Washington is also being charged in a string of sexual assaults that occurred at other Dallas apartments between September 2018 and the day Ezquerro was found dead.

Along with capital murder, Washington is also facing four counts of aggravated sexual assault, two counts of aggravated assault and one count of burglary with intent to commit aggravated assault.

The district attorney’s office said the teenager was 15 years old when the crimes were committed and that due to the severity of the charges, he’ll be tried as an adult.

MANSFIELD, Texas (CBSDFW.COM) – Mansfield Police say they are charging a 42-year-old woman, Merica Sneed, with capital murder in the death of her 9-year-old niece.

Police said on Saturday, July 27, Mansfield Police responded to a cardiac arrest call at a home in the 4200 block of Eagle Drive around 12:30 p.m.

Medics were doing CPR on the child while police were on the way.

When they got there, the officers assisted with life saving measures for Melodi Sneed, but she was pronounced dead at the hospital, police said.

The Tarrant County Medical Examiner’s office ruled Melodi’s death a murder.

The victim’s aunt, Mercia Sneed, was arrested Saturday on charges of Injury to a Child, Causing Serious Bodily Injury.

After compiling additional information Wednesday, the charges against Sneed will be upgraded to Capital Murder.

Sneed remains in custody in the Tarrant County jail.

MANSFIELD, TEXAS (CBSDFW.COM) — The North Texas woman accused of murdering her 9-year-old niece last month, smothered her with a pillow while she laid on top of her, according to the affidavit.

Around 12:30 p.m. July 27, Mansfield officers responded to a cardiac arrest call at a home in the 4200 block of Eagle Drive, where they found Melodi Sneed, 9, unconscious in the home’s game room. Melodi was shortly transported to Mansfield Methodist Hospital where she was pronounced dead.

In the affidavit, one of the responding officers stated that Melodi’s 13-year-old cousin witnessed her being suffocated by his mother, 42-year-old Mercia Sneed.

Mercia and her son were then sent to the Mansfield Public Safety Building so detectives could conduct a forensic interview.

Police said Melodi’s cousin stated he saw her kicking her legs and attempting to scream, while his mother laid on top of her until she stopped moving.

Mercia told detectives during an interview that she grabbed a pillow, walked over to Melodi — who was asleep on a coach — and put the pillow over her face to smother her. She said she pushed the pillow down on her face for two-to-three minutes and laid on top of her while doing so.

The affidavit said she attempted to clean Melodi’s face with peroxide, and then hid both the pillow and peroxide bottle.

A motive for the murder was never mentioned.

Mercia was arrested four days after the murder on July 31 and was charged with injury to a child and causing serious bodily injury.

She is currently facing a capital murder charge and remains in the Tarrant County Jail.

Prosecutors To Seek Death Penalty For Alleged El Paso Gunman Patrick Crusius; US Attorney Investigating As Domestic Terrorism

EL PASO, TEXAS (CBSDFW.COM) — The El Paso district attorney will the seek the death penalty for Patrick Crusius, who is suspected of killing at least 20 people and injuring dozens more near a shopping mall on Saturday, officials said.

At a news conference Sunday, District Attorney Jaime Esparza announced that the 21-year-old will face a capital murder charge, which makes him eligible for the death penalty.

The U.S. Attorney’s Office is also investigating the mass shooting as a domestic terrorism case and that it will also seek federal hate crime charges against Crusius. A manifesto was found on the internet Saturday that appeared to be written by Crusius. In it, he claimed “the Hispanic invasion of Texas” as a motivation for the attack.

Dozens of victims, including children, were reported from the shooting near Cielo Vista Mall Saturday afternoon in the largely Latino community near the U.S.-Mexico border. Many of the victims were shot at a Walmart, according to police.

The 21-year-old was found to be a native of North Texas and had resided in the Collin County city of Allen. CBS 11 News also learned that he had attended Liberty High School in Frisco but later transferred to Plano Senior High School, where he graduated in 2017. Collin College also acknowledged that he was enrolled in that school from fall 2017 to spring 2019.

On Saturday, law enforcement officials from the FBI, Texas Department of Public Safety and the Federal Bureau of Alcohol, Tobacco, Firearms and Explosives could be seen outside of a home in Allen that had possible connections to Crusius. Neighbors in the area said an older couple lives at the home.

Officials familiar with El Paso were shocked that a shooting of this caliber took place as they claim the city has always been safe.

“The loss of life is so great. We’ve certainly never seen this in our community. We are a very safe community. We pride ourselves on the fact that we’re so safe. And certainly this community is rocked and shocked and saddened by what has happened here,” Esparza said on Sunday.

“We will hold him accountable,” he added.

John Bash of the U.S. Attorney’s Office said the case will be treated as domestic terrorism as the shooting meets the definition of intimating a civilian population.

“We are treating it as a domestic terrorism case. And we’re gonna do what we do to terrorists in this country, which is deliver swift and certain justice,” Bash said.
